Will this debt affect my credit rating and credit profile?

Yes, any unpaid debt will probably make it difficult to get other loans or credit. Once you settle with us, we will update the credit bureaus Please note that the credit bureaus are independent from Shackleton and Lynn & Main Attorneys. They are also regulated separately.

How do I submit a complaint?

We take all complaints seriously. If you believe that a person in our employ has not satisfactorily addressed your complaint, please escalate the complaint to admin@lmb.co.za. If you thereafter believe that your complaint has not been resolved to your satisfaction, please submit your complaint to the necessary regulatory bodies

Will you take legal steps against me?

legal action is always a last resort and we only proceed if someone ignores us, is uncooperative, untruthful about their finances, or if it’s necessary to stop the debt from prescribing. Our preference is to work with you on an affordable payment plan without going to court.

What must I do if a summons is served on me?

Contact us as soon as possible to see what can be done to avoid judgment from being granted by the court. If you have no defence to the claim but are simply not in a financial position to pay, the attorney may be advised to suspend further legal steps once a payment has been received.

What are the consequences if you obtain a Judgment against me?

The creditor’s right to claim will be preserved for 30 years, and during this period they may enforce the judgment by having the sheriff attach and sell your property, obtaining a court order for monthly instalments based on your income and expenses, or sequestrating your estate for the benefit of creditors. You will also be listed with the credit bureaus as a judgment debtor and may be disqualified from obtaining future credit
